President Donald Trump's effort to overhaul the National Labor Relations Board (NLRB) hit a major roadblock Thursday. A federal judge ruled his firing of Democratic board member Gwynne A. Wilcox as illegal, ordering her immediate reinstatement to complete her five-year term that began September 6, 2023.
Judge Rules Presidential Overreach Unconstitutional
U.S. District Court Judge Beryl A. Howell delivered a decisive blow to President Trump’s actions. Howell declared that the Constitution explicitly “limits presidential power,” stating, “No one in our system of government was meant to be king – the President included.”
The judge slammed the dismissal as a “blatant violation of the law”, emphasizing that the President cannot fire NLRB members at will. She further criticized any attempts to model leadership as “dictatorial,” reiterating the constitutional constraints on executive power under Article II.
Wilcox Returns to Fight for the NLRB
After filing a lawsuit last month alongside ousted General Counsel Jennifer Abruzzo, Gwynne Wilcox celebrated the ruling. She declared, “I’m ready to get back to work,” during a post-hearing speech. Wilcox highlighted that this legal battle is about more than her position, stating, “It’s not just about me, but I’m glad to be the face of this fight.”

President Trump’s actions left the board without a quorum, effectively halting its operations. Now, Wilcox’s reinstatement revives the NLRB’s ability to function and protect labor rights.
NLRB Faces Ongoing Right-Wing Challenges
The NLRB remains under siege by conservative figures, including President Trump, Elon Musk, and other corporate allies such as Amazon, Starbucks, and Trader Joe’s. These groups aim to dismantle the NLRB entirely, with Supreme Court challenges to declare it unconstitutional gaining traction.
Despite these attacks, the NLRB is still standing. However, the fight to preserve Wilcox’s position and the board itself is far from over.
