Mary Comans, a former chief financial officer at FEMA, has filed a lawsuit against the Department of Homeland Security (DHS) and FEMA, claiming she was falsely accused, publicly ridiculed, and illegally terminated. Comans says she was merely following orders from top officials in the Elon Musk-led Department of Government Efficiency (DOGE) when she approved payments that have now become the center of controversy.

Comans: “I Was Following Orders”

Comans alleges that she was directed by DOGE official Brad Smith to process payments from a $650 million Customs and Border Protection (CBP) program to reimburse cities housing migrants. These funds, she clarified, were separate from FEMA’s disaster relief budget. According to Comans, she received both verbal and written instructions to continue these payments, which were deemed legal.

On February 5, Elon Musk tweeted accusations claiming FEMA had illegally funneled $59 million to luxury hotels in New York City for undocumented migrants. Just days later, FEMA terminated Comans and three other employees, stating the payments violated President Donald Trump’s executive orders.

DHS Press Release and Public Fallout

Shortly after her termination, DHS released a press statement, accusing Comans and others of acting as “deep state activists.” The statement declared their actions undermined President Trump’s policies. Conservative social media amplified these claims. For example, Benny Johnson labeled Comans as “fired for illegally funding migrant luxury hotels,” further tarnishing her reputation.

The Role of DOGE and Immigration Policy

Comans revealed she was implementing executive orders signed during President Trump’s first days back in office. These orders mandated freezing funds to NGOs providing services to undocumented immigrants while still allowing payments from the CBP reimbursement program. Comans claims that Smith, acting under DOGE’s authority, confirmed FEMA should continue these payments.

Despite her adherence to the guidelines, Comans said she recouped the disputed funds on February 10, one day before her firing. In her lawsuit, she argues that DHS violated the Privacy Act by publicly disclosing sensitive information about her dismissal and defamed her as a “deep state activist.”

Having spent over two decades serving DHS, including both Republican and Democratic administrations, Comans describes herself as apolitical. She joined DHS in 2004 after the 9/11 attacks and worked on critical disaster responses. However, she now feels betrayed by the very agency she devoted her career to serving.

“I was fired illegally for doing my job,” Comans told CBS News. “They allowed Elon Musk and others to defame my name and make false accusations.”

Future Legal Battle and Calls for Accountability

Comans is seeking compensation for the damage caused to her career and reputation. However, her primary goal is to clear her name. She also expressed a willingness to return to her position at FEMA to continue serving.

“It’s not about the money,” she said. “My top priority is ensuring my name is cleared.”
