- Rep. Alexandria Ocasio-Cortez sparked a firestorm online after referring to President Trump as “a rapist” in a tweet referencing the Epstein files. Critics, including legal experts, argue the post could cross the defamation line, urging Trump to pursue legal action as precedent looms from recent settlements.
NEW YORK, NY (TDR) — A tweet from Rep. Alexandria Ocasio-Cortez (D-NY) accusing President Trump of being “a rapist” has ignited a fierce legal and political backlash, with many conservatives and legal analysts saying the congresswoman may have opened herself to a defamation lawsuit.
The controversy erupted Friday after Ocasio-Cortez posted a comment on X, formerly Twitter, in reaction to the delayed release of court documents related to Jeffrey Epstein. “Wow who would have thought that electing a rapist would have complicated the release of the Epstein Files?” she wrote, a statement many interpreted as referencing Trump and his legal battles involving E. Jean Carroll.
However, Trump was not found liable for rape — a critical legal distinction omitted in her post — which prompted a swift response across social media and from lawmakers who accused the congresswoman of crossing a serious legal boundary.

While political rhetoric is often protected under the First Amendment, experts are pointing to recent developments involving ABC News and George Stephanopoulos as a cautionary tale. Last year, Trump filed suit after Stephanopoulos falsely stated during a broadcast that the president had been found liable for rape — a misstatement ABC later settled for $15 million plus legal costs.
“Even under the ridiculously lenient standards of NY Times v. Sullivan, you’ve managed to incur defamation liability. Wow,” Sen. Mike Lee (R-Utah) posted on X, referencing the landmark 1964 Supreme Court decision that shields public figures from most libel claims unless actual malice can be proven.
The parallels to Ocasio-Cortez’s tweet are fueling calls for legal accountability. “The President should sue AOC into bankruptcy,” legal analyst Phil Holloway tweeted. “I realize she’s trying to raise her profile but this is way, way too far.”
Political Firestorm with Legal Undercurrents
Trump allies have framed the episode as a broader example of unchecked rhetoric from the political left and a failure by Democrats to respect legal outcomes. “This is defamatory,” conservative commentator Laura Loomer wrote. “And I hope you are sued by Trump for this the same way George Stephanopoulos was.”

The White House declined to comment on whether Trump is actively considering legal action. However, White House communications director Steven Cheung didn’t hold back, stating: “Instead, she should get some serious help for her obvious and severe case of Trump Derangement Syndrome that has rotted her pea-sized brain.”
Fallout and the Bigger Picture
The situation also underscores a growing tension between political speech and legal consequences, especially in an era of instant, viral communication. Ocasio-Cortez has not deleted the tweet, nor has she issued a clarification, further inflaming the backlash.
While the congresswoman has built a reputation on bold progressive commentary, critics argue that this instance marks a line between opinion and defamation, particularly when tied to a legally sensitive issue involving mischaracterized facts.

Trump needs to sue her broke and congress needs to censure her.
She hasn’t gotten wealthy on her salary as a representative. I’d like to know where her money comes from. And separate her from a large portion of it.
