WASHINGTON, D.C. (TDR) — Former special counsel Jack Smith public hearing request landed on House Judiciary Chairman Jim Jordan’s desk Thursday, with the prosecutor seeking an open forum to defend his criminal investigations of President Donald Trump against intensifying Republican attacks.
The letter from Smith’s attorneys, Lanny Breuer and Peter Koski, comes two days after Smith spent eight hours answering questions behind closed doors before the committee. Democrats have accused Jordan of keeping the testimony private to prevent potentially damaging revelations from reaching the public.

Smith’s legal team reiterated their client’s desire for transparency in the Thursday correspondence obtained by multiple news outlets.
“During the investigation of President Trump, Mr. Smith steadfastly followed Justice Department policies, observed all legal requirements, and took actions based on the facts and the law. He stands by his decisions.”

The attorneys also requested that the videotape of Smith’s testimony be released in full, arguing the public deserves to hear directly from the former prosecutor rather than through selective leaks.
Jordan’s office did not respond to requests for comment on the Jack Smith public hearing demand, though the chairman indicated after Wednesday’s closed session that a public appearance remains possible.
Smith Told Lawmakers He Had “Proof Beyond a Reasonable Doubt”
During his private testimony, Smith forcefully defended both criminal cases he brought against Donald Trump, telling committee members his team had developed proof beyond a reasonable doubt that the president engaged in a criminal scheme to overturn the 2020 election.

Smith also addressed the classified documents investigation, stating his office gathered “powerful evidence” showing Trump willfully retained highly classified materials after leaving office, storing them in a bathroom and ballroom at his Mar-a-Lago social club.
“The decision to bring charges against President Trump was mine, but the basis for those charges rests entirely with President Trump and his actions.”
The former prosecutor notably did not invoke his Fifth Amendment rights during the lengthy session, unlike some of his former deputies who had appeared previously.
Republicans Label Investigation “Politically Motivated”
Jim Jordan subpoenaed Smith in October, accusing him of running a partisan probe and conducting abusive surveillance of lawmakers. The Ohio Republican said Wednesday’s testimony did not change his view that politics drove Smith’s decisions.
The committee has focused particular attention on phone records of certain senators and a congressman collected during the January 6 investigation, which Republicans characterize as evidence of weaponization against political opponents.
Smith faces potential prosecution himself. In October, Trump called him a “criminal” during an Oval Office press conference with Attorney General Pam Bondi present, urging the Justice Department to investigate and imprison him.
Democrats Say Jordan Fears What Public Would Hear
Rep. Jamie Raskin, the committee’s ranking Democrat, offered a sardonic assessment after Wednesday’s closed-door session.
“Chairman Jordan made an excellent decision in not allowing Jack Smith to testify publicly, because had he done so, it would have been absolutely devastating to the president and all the president’s men involved in the insurrectionary activities of January the sixth.”
The New York Times reported earlier this month that House Republicans were reluctant to give Smith a prime public platform out of concern he could embarrass Trump by making a compelling case for the indictments.
Both criminal cases were dismissed or dropped after Trump’s 2024 election victory, with Justice Department policy preventing prosecution of sitting presidents.
If Smith truly has nothing to hide, why would Republicans prefer to keep his testimony behind closed doors rather than let the American public judge for themselves?
